Is it legal to possess a book about marijuana cultivation or is it considered drug paraphernalia?

demonsinconvent asked:

I’m just wondering if I could get in trouble for having the book while I get stopped for a traffic violation and have no bud, etc., on me.

No, it is not illegal to have a book, but it might make the officer look a little harder for the bud.

As far as I know, possession of the book is legal; but a court may rule that the book is probable cause for a policeman who sees it to conduct a search. Keep the book in a paper bag out of sight.

it’s perfectly legal but they can use it against U citing it as an excuse 4 “suspicion” – allowing them 2 “legally” search U w/o consent. NOW, pass it this way …

It’s considered literature, which is clearly protected under the 1st Amendment. After all, such a book can have a lot of legal uses, including helping one investigate and find evidence on those who grow pot. A lot of police detectives and drug enforcement agents happen to have such books.

its not illegal, but it will give the cop probable cause to search the car if he can see it from the window. and if he is already searching, he will def. be calling a dog to the scene and you will probably be sitting on the side of the road watching cops and dogs all over your car.

I agree with logic; don’t worry about it, the book is legal. Don’t be surprised if they still want to search you and your car though.

It is perfectly legal to own. TAKEN ALONE, it would not give police probable cause or reasonable suspicion to do anything. If there were some other reason to suspect you might be a dope fiend, then this could arguably be additional evidence against you and/or form the basis for suspicion.

If you dont have any bud, OR SEEDS, youre fine. The book of course would be completely legal. They can only charge you with drug paraphernalia if you got the drugs to go with the particular item, or in the case of a resinated bowl piece or something like that.
