Lawyers for Richard Cooey argue in a federal lawsuit that Cooey — 5-feet-7 and 267 pounds — had poor veins when he faced execution five years ago and the problem has been worsened by weight gain.

The lawsuit, filed Friday in federal court, also says prison officials have had difficulty drawing blood from Cooey for medical procedures.
Cooey, 41, is sentenced to die for raping and murdering two young women in 1986. His execution is scheduled for Oct. 14.
His attorneys say a drug he is taking for migraine headaches could affect the execution process. The drug Topamax, a type of seizure medication, may have created a resistance to thiopental, the drug used to put inmates to sleep before two other lethal drugs are administered, Dr. Mark Heath, a physician hired by the Ohio Public Defender’s Office, said in documents filed with the court.
Heath says Cooey’s weight, combined with the potential drug resistance, increases the risk he would not be properly anesthetized.
“All of the experts agree if the first drug doesn’t work, the execution is going to be excruciating,” Cooey’s public defender, Kelly Culshaw Schneider, said Monday.

But head down to Southern Arizona, near the border, do the exact same thing, and in many cases you get off scott-free.

No prosecution, no penalty, no prison…in fact – not even a slap on the hand.

County prosecutors say it’s enormously frustrating and for the drug cartels, enormously profitable.

But this sweet deal only applies if you’re illegal and smuggling 500-pounds or less.

And therein lies one of our country’s dirty little secrets: Mexican drug runners getting a free pass back to Mexico if they’re caught with less than a quarter-ton of pot.

Cochise County attorney Ed Rheinheimer spells it out. “If a seizure is made of an amount less than 500 pounds, the case doesn’t get prosecuted.”

You read that right.

Drug runners doing business without punishment.

But don’t blame the county attorneys.

Remember: These are federal cases and should be federally prosecuted.

But guess what?

They don’t get prosecuted by the feds and now, they don’t get prosecuted by guys like Ed Rheinheimer, either.

And while these “weight limits” are unfamiliar to most Americans – drug cartels know them well and plan accordingly.

And they do it every night…all along Arizona’s border.

War on drugs? Don’t make me laugh. This a full frontal assault on the American citizen and our society. Think I’m wrong? Well, consider this, it seems George Orwell’s famous quote, “All animals are equal, but some animals are more equal than others” has never been more accurate than it is in America today.

Is it any wonder Americans are outraged over the current illegal immigration situation? While our government winks and nods at Mexico, we’ve watched as illegal immigrants are afforded more and more rights in our society than American citizens – American citizens who happen to get stuck with the bill to pay for all of this generosity and are hauled off to prison if we dare to think of breaking any of the laws that illegal aliens receive a free pass for breaking.

Our rewards for being Americans and legal American citizens are higher taxes, higher crime rates, lower wages, higher insurance premiums and on and on while illegal aliens are rewarded for their crimes against our borders and our society with:

Free health care – U.S. taxpayers pay the medical bills for illegal aliens yet the cost of most American’s monthly health insurance premium for even a small family has now exceeded their monthly mortgage payment and if we fail to pay for our insurance and need medical care, our home will have to be sold to cover the costs.

The right to be above the law – Illegal aliens can hide in ’sanctuary cities’ that say, “we care more about the rights of criminal aliens than the rights of our own citizens” yet American criminals are not afforded a place to hide, in fact, they are hunted down.

In-state tuition – Senators Hillary Clinton, Dick Durbin, and other members of our Congress are proud sponsors of the illegal dream yet American children have to pay more for their college tuition than their illegal counterparts as some states have already implemented in-state tuition for illegal aliens in direct violation of our federal law.

Day laborer centers – American taxpayers fund illegal day laborer centers yet there are no ‘gathering places’ being built for unemployed American workers.

No ID necessary – “The stigma and humiliation of constantly proving lawful status is unacceptable”, says the ACLU yet Americans are expected to show 2 forms of verifiable ID to obtain a driver’s license.

Fair share of Katrina disaster aid – Hillary Clinton – defender of the illegal alien, made sure that illegal aliens got their ‘fair share’ of the Katrina disaster aid paid for courtesy the American taxpayer.

Using our courts to see that crime pays – 2 illegal immigrants won an Arizona ranch in court. Do you think an American trespasser could get that lucky in court?

Turning our sense of right and wrong on its head – The Minuteman Project and other anti-illegal immigration groups are targeted as bands of racists and even called ‘vigilantes’ by our President and ‘bigots’ by a member of the U.S. Senate. Americans who are trying to help the border patrol, because of our government’s total disregard for the citizens of this nation, are rewarded by being vilified by the very officials failing to live up to the office they occupy. In this topsy-turvy world, criminals are now accepted as the victim and law-abiding citizens are handed the bill and openly accused of racism if they disagree. Or arrested if they dare to protest.

Our Border Patrol agents languish in prisons while known drug smugglers are given immunity.

And now, American citizens can expect to face prison time for small amounts of marijuana while illegal aliens can possess a quarter of a ton – and bring it across an international border – with absolutely no ramifications?

City officials (encouraged by the mayor) consistently punish landlords for crimes committed by tenants. For example, if a tenant gets caught selling illegal drugs, the city condemns the building even if the landlord has no knowledge of the crime. The city does it upon the arrest of the tenant, even BEFORE the tenant gets a chance to defend himself in court, and certainly before any conviction.

The city says that if the police knows – the landlord also knows. I called the police to see if they have any knowledge of suspected illegal activity. Their response was: ” we will never tell you what we know.” Yet the city holds the landlord responsible, and punishes him.

Isn’t this a violation of the “innocent unless proven guilty” rule? Is there any state or federal law that protects against such abuse of power?

The drug this person was caught with was cocaine, 100 grams, so why would one be a scheduled drug and one unscheduled? A few years ago when I got arrested(first and only time), I invested in a good lawyer so that I was more likely to get into the ARD probation program(a program for first time offenders that allows you to get your record expunged afterwards). It was for a nonviolent crime. He charged me $5000 retainer. Being naive and desperately wanting to get into ARD and avoid criminal conviction, I told him that I would pay him $500-700/week on a payment plan…despite these large weekly payments putting me into abject poverty.

My case was put on the back burner for about a year, by both the court(having much bigger trials to worry about) and my lawyer. The lawyer had to recontact a few people, but nothing that was too much extra legwork. Nine months after I first started working with this lawyer, he dropped word that he would need another $2500 IN ADDITION to the $5000 I’d paid off months earlier. Here’s the thing that makes it really bad. Two weeks earlier, my mom died and right after that, I picked up a really bad case of the flu and strep throat. So I was already emotionally distraught about my mom, and I’d been out of work(unpaid) for the past 2 weeks, and this guy just sat in his chair and smugly said he would need another $2500, AFTER he knew about my mom’s recent death. I repeated that I’d been out of work for two weeks and it would be hard for me to get the money but I would try my best, and he said, “Well, I need at least $500 by tomorrow morning”.

Do you think he demanded the $500 based on my past record of being willing to make such large payments? Do you think I was a pushover to agree to pay $500/week in the past?

The good thing is, he helped me get into ARD though. So I’m happy about that. On the day I got into ARD, other lawyers(my lawyer’s friends/peers) kept telling me how great of a lawyer I had.

Other times, he made remarks I found to be condescending. For example, when a close friend of mine died shortly after my mother died and I told him, he quickly remarked, “What did he die from, drugs?” I didn’t think too much about the remark, but when I told my friends what he said, they were wildly offended and told me that I shoulda been too. Things like that.

So bottom line…do you think it was a mistake that I was so desperate and willing to “pay anything”? Also, I completed ARD and very soon I will be petitioning for expungment of my record. From what I’ve heard so far, a lawyer is not required but it might be a good idea. If so, should I go back to this guy, or to someone else?
Brianna, thank you for your very detailed response. The reason the lawyer charged so much was because: 1, he is a fairly big name lawyer(his father was a senator a few decades ago), and 2, because the technical name of the charges I had made the crime look worse than it really was, so for that reason my case was challenging at times. E.g., a charge called “terroristic threats” makes me look like Bin Laden, when in reality I was only verbally fighting with someone.

I agree that he took advantage of my over desperate willingness to pay him as much $ as I could. And no, I never received any billing details. However, I did get ARD as opposed to misdemeanor convictions, which I guess helps a bit.

The reason I mentioned my friend’s death is because my lawyer knew my friend through a mutual friend of theirs. In fact, it was this (deceased) friend that introduced me to my lawyer. I figured I’d be courteous and let my lawyer in on the bad news. Big mistake apparently.
Here’s more info. My arrest resulted in not only criminal charges but a related civil court summons as well. My lawyer told me that this was separate from the criminal charges, therefore, it would cost an extra $2500 for him to accompany me to the civil hearing. A friend told me that I wouldn’t need a lawyer for that, so I went there alone…good thing too, since the civil charges got thrown out anyway, so it would have been a waste to pay for the lawyer since nothing happened with it.

So judging by that experience, I am wondering if maybe I should attend the record expungement hearing alone? Would a lawyer be that much more beneficial, or would it be as unnecessary as having a lawyer for a civil/tort hearing?
