Drug Possession: Am I Allowed to Own a Knuckle Belt Buckle at Home in Texas?

Question by Kenny Tran: Am I allowed to own a knuckle belt buckle at home in Texas?
The Texas Penal Code states that I cannot “knowingly possess” knuckles. Does “possession” still apply If I only have the belt buckle in my home and not in public? The knuckles were my grandfather’s, he was a drug dealer in China, I keep them for personal purposes and I don’t intend to use them, especially not try to damage them.

I am over 18 and I have full ownership of my house.

They are legal to own but not to wear. The way you are describing that you want to store them would be legal.

  • Chet:

No, by law you can not even own them.

Sec. 46.05. PROHIBITED WEAPONS. (a) A person commits an offense if he intentionally or knowingly possesses, manufactures, transports, repairs, or sells:
    (6) knuckles

    (8) “Knuckles” means any instrument that consists of finger rings or guards made of a hard substance and that is designed, made, or adapted for the purpose of inflicting serious bodily injury or death by striking a person with a fist enclosed in the knuckles.

But the likelihood of getting caught if you keep it at home is very low, but remember it is a class A misdemeanor.
