Question by smokey mc pot: If I am busted for drug charges, will there be in repercussions for my roommate if she doesn’t own or use it? ?
We have separate leases, I just want to know if she has any legal liability.

I don’t need to worry about that. I’m homeless and Ginger my mate usually takes the rap for his master 🙂

    Did they find the drugs in your house? If they did and you admitted the drugs were yours, then your roommate shouldn’t have anything to worry about. Of course this was assuming the drugs weren’t found in their room or personal possessions. Then they might get questioned about the drugs.

    If they found them on you when you were away from home or something like that, then your roommate really has nothing to worry about.

    I wouldn’t think so. But every state is different you should look up your laws.
    I think if this were a problem then more people would be in legal trouble than there are

    There is a legal principle called “constructive possession”. If there is something illegal in a place where you are in control, and you know it is there, you can be charged.

    Being on the lease, even if they are separate, would fit the definition of “control” if the drugs were found in the apartment.
