Question by Hoon: Caught with weed by cops what kind of trouble am i in?
Me and my friend were chilling outside when two state boys rolled up on us we were high as **** they could tell, they asked to search us my friend had a pipe on him but i had nothing on me. They asked to search the car my friend said sure don’t know why but they found the weed and a grinder needless to say they took us in a we got charged with possession of marijuana and drug paraphernalia. my question is what kind of trouble am i looking at i live in delaware and this is my first run in with the law ever. Also they did not read us our rights but i was told they didn’t have to why is that.

If your old enough you could possibly go to jail or be fined.

    If they arrest you, they must read you your rights. No choice on that one.

    I don’t know the law in your state, but if you’re at home on YA, you’re probably not in huge trouble. Don’t know, though, what the record will look like.

    You will be fined. Never let a cop search you. They don’t have the authority without probable cause and the suspicion that you were high is not probable cause. They need actual evidence. Just say “I don’t consent to any searched today sir.”

    If you had nothing illegal on you and it wasn’t your car, then they have nothing on you… unless you admitted that it was your pot or something stupid like that. When you go before the judge, tell him/her that you had no illegal substances on or around your person when you were harassed by the police. When they bring up the weed in the car, tell them that it wasn’t yours and you had no knowledge of it being there. If the cops lie and say they found the weed on you, then you may have problems.
