Although private possession of marijuana was decriminalized in New York in 1977, New York is currently the Marijuana Arrests Capital of the World. Police make these arrests by exploiting a “loophole” that makes possessing marijuana in public view a misdemeanor. Oftentimes, the police demand that people — usually young people of color — empty their pockets, and when they do the marijuana becomes in public view and they are charged and arrested for the misdemeanor marijuana possession.
