if it’s only the pipe, but no drugs… to my understanding you can’t get in trouble for it…. and my friends and i are trying to prove our point. because we saw someone get arrested for it.. but there was no drugs, just the pipe. and even if there is marijuana in the car, isn’t there a limit before you actually get in trouble for it? its happened to my friends.. but if you don’t have much they just make you step on it.. my friend says I’m wrong and we probably think that because we live in Santa Cruz county.
the reason why i was asking was because plenty of my friends have been found with weed and unless you have a certain amount, no one i know has gotten in trouble.. i don’t appreciate being called a moron… or any of that sort.

Of course you can, and you should know the answer, you said you saw it happen.
Possession of drug paraphernalia is illegal everywhere I have lived. Additionally, if the pipe has been used it will test positive for residue.

If the pipe has residue in it, that residue can be tested. If it tests positive for illegal drugs, you can be arrested for possession of paraphernalia.
Even if the pipe is not yours, you can be arrested if it is your car. There is a legal term called “constructive possession”. If you are in control of the area, and know there is something illegal, you can be charged.
I am here to tell you my friend that you most certainly can get into big trouble for having drug paraphernalia in your car. I know of numerous people who were charged for it, one of which was my very own brother sorry to admit. Some officers may give you a break and over look it because they don’t want the hassle of paperwork. While other officers aren’t not bothered at all by the paperwork and are more than happy to slap charges on you. Problem is once you have a charge against you if you get pulled over again the officer will have the heads up that you have been busted before for paraphernalia and will most likely be looking around to bust you again. It’s not worth it.
Yes – you can get in trouble for having paraphenalia. Also – pot is illegal. The laws of the state you’re in determine the penalty.
If it’s completely clear of illegal residue or is just used for tobacco, then it’s perfectly legal. However, if it’s found with marijuana residue, you kay be charged with paraphernalia which is a misdemeanor.
