Ok, SO let me give you an idea of whats happened so far.
We have had a renter in our house(the same house we live in) for the past couple of months. He has been there with a verbal agreement. Last week him and his friend asked if they could use the porch of one of our rental houses down the road to paint on. We gave them permission for only that. The next day it started to rain and they asked for the keys to use so they could be dry while it was raining. That was it. The renters friend proceeded to move in all of his personal possessions inside the house without permission. He then painted his belongings on the floor with no protection leaving paint everywhere. The next day(we still were unaware that anything was happening) a neighbor called us and informed us that there was someone having a party at the rental house. We found that there was alcohol all over the floor and the whole house smelt of smoke.
When we found out we gave the renters friend an hour to move all of his stuff out before we called the cops, and asked the renter to permanently leave our residence because of such a violation of trust(he was told specifically that he was only allowed to stay during the rain for the afternoon).
Anyways, when he wouldn’t leave we called the cops. The cops said that we could not have him leave because of renters rights. The only way we could have anything done to him was if he was under the influence of illegal substances. Sure enough he tested positive for crack cocaine. That was only enough to put him a away for one day. the next day he came back and just stormed into his room. We left for a trip to las vegas for Christmas the next day and all was well for another day. Before we left we had locked all of the doors that held personal property. On Christmas night we get a call (by someone in our family who stayed at the house) that there has been a party and the renter was trying to get into one of the locked doors. Our family member called the cops but they wouldn’t come. After a while he pushed her down away from the door and used a credit card to get into the room. We called the cops from vegas and told them that they had pushed our family member down and they Finlay came. Unfortunately because the room he was trying to get into used to be his rented room 3 months ago, the cops couldn’t charge him for anything. However our family member was able to make a citizens arrest for battery, which landed him three days in jail. While he was in jail we moved all of our furniture out of his room. This is because one of the complaints he made to the officer was that we were using his room as storage. While we moved these items out of his room we found a crack pipe and crystal meth. He is coming back tonight and we are worried about what he may do. We have a handicapped person who he feels particularly angry at because he feels that he asks him to do too much. He could easily do harm to him or any of the rest of the people living at our house. Yesterday we filed an official notice of eviction which means he has thirty days that he could cause our family harm
What can we do? Can we have the cops search his room and find the Meth we know is there? Can we file some sort of a restraining order? Should we move out of our house for a month? The police aren’t able be helpful, and we need some advice on how we can live safely for the next thirty days.

Hi guys, any help on this would be great. I am most likly going to let my friend stay at my house for a while, but there are two families living in that house, and I don’t have room for all of them.
FYI we are in California, for any state laws that might apply.
I called my friend and told him to mention to the police that they found drugs and drug paraphernalia. They have already called the police about everything else.
Oh, and btw the renter stole 100 vicodin from the handicapped man about a month ago… just a additional detail.

Get an attorney and begin eviction.
If he has been there less than 30 days and does not have a lease, I dont understand why you cant call the police and have him removed for trespass / burglary, change the locks and file a restraining order.
