Question by lola: If you got caught harvesting marijuana in a national forest, could you claim you didn’t plant it and be ok?

Could you blame it on other people who have bigger criminal records, or true in dealers to get off your charges?

Have you ever heard the phrase “Possession is 9/10ths of the law.”? Basically, no. Hypothetically, if you were caught with marijuana and were going to be prosecuted, there is a chance you might be offered a deal by the district attorney’s office so they can catch the bigger fish but it’s not at all something one can rely on. Drugs alone are a Federal crime, but “defacing” a national forest by planting illegal substances there would probably add some time onto the sentence. Get out while you still can! 🙂

Nope, possession with intent to distribute and cultivating a controlled substance. No story will get you off the hook.

    Hey hey hey well first of all you shouldnt be planting marijuana in a national forest, thats a dumb idea. Really lol and second why do something u cant live up to take the blame for? Its not as easy as u think to just say oh it wasnt me and worst of all blame it on someone else??? how dirtyyyyy. I would suggest harvesting at ur house or renting a trailer up in the forest not just in the middle of the national forest

    You got caught harvesting it. It is considered yours and you will take the responsibility for it. No blaming others for it.

    I think that the best you could hope for is to convince them that it wasn’t your plant. However, that still leaves you on the hook for possession of what you harvested. If it was in your hands, you had possession of it, you lose.

    You get busted with it in your possession, you are the one going to jail no matter where you stole it from, found it, what ever. Besides, the stuff growing in Natl.Forrests belongs to the govt! 🙂

    One who harvests it is also in possession of it. Cultivation does not consists solely of planting. In answer to your question, you can claim anything you want. Probably won’t make any difference, however.

    No, you would go to jail. You may convince someone that you didn’t plant it but if your trying to pick it you were stealing and in possession of pot.
