So I was charged with possession of MDMA as well as possession of methylone. When I was caught, the substance field tested positive for meth, as any derivative of mdma or methylone would. I thought the substance I had was methylone, so that’s what I testified that it was when I talked to the police. So the lab tests come back months later and it turns out it was purely MDMA. Well, my methylone charge wasn’t filed, and now my only charge is possession of mdma. However, in my state’s code (Iowa), the law states “knowingly and intentionally having in possession a controlled substance, to-wit, MDMA-Ecstasy”. But I DIDN’T know that’s what it was. Is there any possibility of ignorance helping me out in this case?

Methylone is also illegal in the US so by your own admission you were in possession of an illegal drug, it was just a different one (although very similar) than you thought.

No, there isn’t. If “ignorance,” as you call it, was a valid defense in a court of law, a drunk driver could get out of a DUI charge by saying that they didn’t know that alcohol impairs your ability to drive.

If you have any illegal drug or substance in your vehicle or on your person, whether or not you know it’s there (e.g., “these are not my pants, sir.”), the law presumes you to have possession and control over it. As of 2011, the DEA placed a ban on methylone, so yes, you were in possession of a controlled substance.

If you have any knowledge of the law, then you know that it is not your friend. In a court of law, the only relevant things are the facts and the law as it is written, not your personal beliefs on fairness, or your “ignorance” of what is legal and what isn’t. To know these laws is your responsibility. Excuses are not acceptable as a defense.

When you do something that you are not supposed to do and you get caught, it means you were careless.

    Firstly if you do not have a prescription bottle with your name on it having any prescription drug including blood pressure meds can result in an illegal drug charge. There is no such thing as legal prescription drug with out a prescription. And even if you do you are not to be traveling with the entire prescription just the dosage that would be reasonable for you to carry if it is a controlled substance like mdma.

    Not knowing what you had in no way grants you immunity to the charge…

    A good lawyer and some drug money may help lower the charge, ask some jail friends who’s the best drug lawyer around in Iowa….
