Question by K.B.: On jury duty tomorrow – question on categorizing last case I was on?
I want to remember, in case it comes up in jury selection, what type of crime a case was that we tried. It was for Cocaine possession for the intent to sell. Is the best way to refer to that, simply as a felony? Or how else can I categorize that so I sound resonably intelligent!

Also, has anyone had the experience of a lawyer, or judge, deciding to excuse a potential juror when that prior case did not come to a verdict because it was “hung”??? It wasn’t me, but I don’t mind being excused because it MIGHT have been me!

Well, you can just say you were on the jury for a criminal case. If they ask what kind, just say it was for cocaine possession with intent to sell. In almost every state that’s a felony, but it’s irrelevant as far as the attorneys are concerned; they just want to know what kinds of cases you have heard (in fact, if you just called it a “felony,” they would probably say, “what kind of felony was it?”).

Being on a hung jury in one instance almost definitely does not excuse you from future jury duty… and being on an “almost-hung-jury” is even less likely to get you off… sorry!

Honestly without knowing what kind of case it is it would be very difficult to know what will get you excused from it. Its a bit of a psychological game. The attorneys want you if they think you will be persuaded to their side. They come to this conclusion by asking various questions and what you think may be a good answer to get you kicked off may just be the one to keep you there so just answer the questions and be honest.
