Question by Alben Murcia: Got arrested for drug possession, but didn’t get convicted does it show in background report?
I was arrested when i was 19 for possession of cocaine. It was 1 gram. I went to court did my n.a, took my drug tests all for a year and i was told i would not get convicted if i did all that. Now in trying to get an apartment and this popped up. Causing me to get denied. But i had a background check done for work and i had no problem… if i was not convicted does it show as less of a felony? This happened 3 years ago
This happened in Florida. And i was not convicted. How can i remove this?

You might have to do what is called ” Expunging ” so hopefully it doesn’t pop up again … not sure how it’s done or what all you need to do, might involve courts & attorneys… If you weren’t convicted I don’t know why or how it popped up.

Arrest records will stay on your criminal file until you have them expunged. Expunged means you file papers with the arresting institution to request that your records be deleted. Since you received the conviction, a judge would have to ultimately make that decision.

How long arrests and convictions are allowed to stay on file with the justice system depends on the criminal laws in the State you reside in or where they occurred.

You probably were denied the apartment lease because of what you were convicted of.

    It is on record for being arrested. Everyone os diferent but then you had coke and this can be a cause for your problems. It cannot be wiped out. Good luck stay clean.
