Question by Armstrong Productions: I have possession of Marijuana on my background check but it says disposed?
I have possession of Marijuana on my background check that came back for Kaplan University. The background check says disposed of on xx/xx/2013, and also says DIVERSION. Because I received Diversion, was ordered to pay fines, attend a drug class, and do community service…I’ve done my drug class and 20 hours of community service and I will be paying my fines next week. The BC says DISPOSED OF…will I still be able to attend school for the Criminal Justice program and receive a job? If the charge is disposed and I meet my obligations for the diversion????

Please talk with a couple different “criminal defense” lawyers for some legal advice, preferably those who are in “good standing” with the “American bar association”. (Some attorneys will offer a free initial consultation.) I’m not sure if a past conviction will preclude an individual from taking licensure exams for a law enforcement job or obtaining such a job itself.    Read more...

Question by Bobby: Today I was cited with a ticket for possession of marijuana (17 years old Massachuesetts)?
On the ticket it says Possession of marijuana. However when they searched the car they did not find any marijuana they found a bong. They claimed it had residue on it. My question is since the citation says “possession of marijuana” and not “possession of drug paraphernalia” if my case would be dismissed on a technicality?

Doubtful, unless you have a good lawyer to argue your case. The charge will probably be supported through police testimony or evidence that they produce in court (which doesn’t have to come from you). Police always enhance the charges to show the public what good servants they are.
