Legal Question Regarding Firearms and My General Well Being?

Currently I have three roommates: My girlfriend, my sister and her boyfriend. I just found out that my sisters boyfriend used to be (less than six months ago) a drug dealer. He apparently sold marijuana and lots of it. Obviously this worries me quite a bit. What worries me more is that his previous residence was raided by the SWAT team as a result of his dealing. This apparently was also less than six months ago.
Now we all live together. I consider myself to be a law abiding citizen, I don’t do drugs or that sort of thing and I pretty much ignore my sisters boyfriend and just keep to myself at the house. The problem is I own a rifle which I keep locked in a safe in my room. My question is, if something were to happen at the house because of this guy, and the police were involved, would it affect me in any way because I have a weapon in the house? It’s perfectly legal for me to own it in my state (VA) but with the possibility of illegal drugs in the house does that change?

…you are with someone who has cocaine on them (you don’t know about it of coarse) or has it in their home and the cops find it? What is the procedure? Do they book you then drug test you and let you go? Or do you still have to go through the courts and ‘prove’ you don’t do drugs?

If the drugs are on the person, they are the only one that gets charged.

If the drugs are in the immediate area, and no one claims them, everyone can be charged. I can tell you from experience the chances are slim anyone will admit ownership.

If it is your house or your car, things get worse. There is a legal principle called “constructive possession”. If you are in control of the area, and there is something illegal, you can be held responsible.

If a hotel maid found ashes from pot in a hotel room I was in for vacation (hours away from home) can I get charged for possession even if I pass a drug test? I had some friends who smoked in my room and they ashed on the table.

Thoughts?
What is the statute of limitations if they did decide to “come get me” (if they even have authority?) A week, month, year, forever?

Or is it only if they found it on you at that time can they charge you?

I have a hypothethical question — lets say my sister and her husband were selling illegal drugs from their house. well not really selling it, but storing it for my other relative who is selling it from there but not living there. lets say the police found out. would my sister and her husband go to jail? if so, for how long? they have 2 kids. one is 16 and the other is 5. the 16 could go live with her bio dad, but what would happen to the 5 yr old? would she go into foster care? would any family be allowed back into the house to gather the 5 yr old’s belonging or would we have to buy everything brand new for her? would would happen to the house? if they went to jail, would the cops sell it? who gets the money? my bf and i are on the poor end, we live paycheck to paycheck but we could afford to have the 5 yr old live with us. do you think they would place her with us if no other family wanted her? just wondering what would happen in this situation. and when the police did show up, how long until the 5 yr old came to my house?

Yes as you are the owner or listed tenant of the home. It is your legal responsibility to ensure the drug activity does not take place in your home. In other words if the person in question is arrested in your home, there are good odds you will be arrested as well.

first let me say I am no criminal. My question is can you be charged with possession with something if you had no say so in it being there example (not situation) lets say I let a buddy use my car and he goes and picks up drugs. Then he comes to get me we get pulled over can I be charged?

Yes, you can be charged for that in a vehicle. It is called “constructive possession”. The lesson here is this: pick your friends wisely.
