A night ago my friend got his license. We went out driving and smoked an illegal drug. A police officer followed us home and pulled us both out of the car, proceeded to frisk me and found nothing. He asked me if we were smoking and I admitted to doing so and he took my friends provisional license, which only permits him to drive until nine PM. Whereas we were driving way past nine. Now did this police officer charge us for the drug or just get my friend on an after nine charge?

i think he basically just took his license
hes just not going to get it back
if he didnt take you name and ticket you he didnt charge you

Seems to me that you would already know if he charged you. You would have been arrested.

I am guessing that your friend just got his license taken away and probably will not be able to get a new provisional license for awhile.
If you already smoked the drugs, you can’t be charged for possession because you no longer possess them. You friend may be charged with driving under the influence of a controlled substance (DUI), but I think this is unlikely if he was not arrested on the scene.
If there were no drugs found, then there cannot be a drug charge. You could be charged with a DUI if that can be proved through any test that was done. Otherwise, the terms of provisional license were violated and it will be taken away for some period of time.
When a law enforcement officer pulls you over, finds nothing illegal in your possession and asks you if you were doing so and so, answer NO. As they say in the military “NEVER VOLUNTEER INFORMATION”.
