Just like with drug possession charges, sentences for trafficking and manufacturing a controlled substance depend on the drug’s classification and the amount.
There are several other factors that could increase penalties for :
¨ If the drug was manufactured in the presence of a minor (less than 18 years)
¨ If the drug was distributed or sold near a school
¨ If the defendant has prior criminal convictions
For example, if you have been charged with manufacture or delivery of cocaine, a group 1 drug, you probably face one of the following sentences:
¨ More than 400 grams of cocaine: life or for a term of not more than 99 years or less than 15 years, and a fine not to exceed 0,000
¨ More than 200 grams but less than 400 grams: life or for a term of not more than 99 years or less than 10 years, and a fine not to exceed 0,000
¨ Four grams or more but less than 200 grams: felony of the first degree
¨ One gram or more but less than four grams: felony in the second degree
¨ Less than one gram: state jail felony

Drug Possession: Stefano Cucchi. Interview with Ilaria Cucchi *english version
640 x 480 pixel Interview with Ilaria Cucchi a year after Stefano Cucchi’s death by Mimmo Rubino *english version October 22nd 2009: Stefano Cucchi dies. 7 days earlier he had been arrested for drug possession. Up to the time of arrest Stefano is in good health conditions, but at the trial his face shows clear signs of violence. Later he is moved from jail to the prison hospital. In all likelihood his death is the consequence of the acts of violence he suffered during the arrest, these acts were committed by the people who should have taken care of and healed him: Government, police, doctors. Stefano’s family decide to publish pictures of the corpse and those photos end on the cover of newspapers and magazines. They prove what happened. On October 21st, a year after Stefano’s death, I interviewed his sister, Ilaria, asking her to talk about those photos.
