Okay guys, I recieved my first charge in June of 2011. It was possesion of marijuana and paraphinalia. Previously I had a perfectly clean record. It is still on-going. I then recieved a under-age drinking charge Oct. 9th. Is there any way to get these expunged or dismissed? Because I want to get into the Military. Please if you’ve been in this type of situation or have knowledge on it help me out!

Really your best bet is to speak to the judge. Tell him your plans and see if he will work with you…that is unless you have an attorney who can get you off.

That’s up to your lawyer. The military cannot help you get your cases dismissed or expunged. You would be unable to join the military at all with these charges.
Sure you can get them expunged it still doesn’t mean that the military doesn’t want to know about them and will find out about them if you kinda forget to tell them. You’ll need a waiver for the drug charge definitely and I really don’t think you’re going to get one. They’ll let you slide on the old standby story of “yeah I tried it once or twice” then dumped my friends for being losers but an actual “possession” charge I don’t think so. It’s one thing to try it it’s another to be charged with possession. The way the military looks at that one is you might as well have been charged with “poses ion with intent to distribute.” Won’t be a show stopper for your life if you went and tried to get in but I definitely wouldn’t get my hopes up at all and whatever you do come clean because they will find this stuff, expunged or not and you will never get a dismissal. If they were going to dismiss anything you wouldn’t have anything to expunge.
This country has too many draconian laws on the books made by old white men. Can you plead down to just paraphernalia? Get some council from an attorney, may find some free help. Marines don’t like it, don’t know about the other services.
If you have a drug charge, you are not qualified to enlist and we will not consider a waiver at this time. Sorry.

No Service is issuing any waivers for anything…
They are trying to cut manpower levels…asap…
