Alright, my friend just got “busted” for having alcohol [2 SEALED bottles of Smirnoff Ice] the trunk of her car, on school grounds, parked in the student lot. The drug dogs smelled marijuana in or around her car… [apparently some friends may have smoked in her car a night or two before] so that attracted the dogs.
She received a 400 dollar fine, an underage, 90 day license suspension, and 3 days out of school suspension.
now my question… can she take this to court? I think the punishment was entirely too harsh. BECAUSE… 1) she wasnt driving the car at the time…. 2) she wasnt under the infulence at that time [or at school] 3) because the bottles were in the trunk sealed…. what if that was her parents car and they forgot to take it out the night before?

the gave up her rights to go to court when she accepted the plea agreement with that punishment…she was lucky..if she went to court she could have been sent away until we 25th birthday.
Minors in pocession don’t have to be driving to be guilty, they don’t have to be drunk to be guilty, and no one is dumb enough to think that was not her booze.
Quit making excuses…she should be in rehab.

Possession. What are the school’s rules about having alcohol on campus? I think that unless her parents come in and say they left it in her trunk themselves, she should be lucky that there was no pot found IN her car. If I were her mother I’d be freaking out about that one as well.
She can try to take it to court, but it is against the law to have any alcoholic/drug substance on school grounds. Chances are she smokes weed if she is letting people do it in her car. So sorry, but that sounds like a fair punishment to me. Anytime a minor has possession of alcohol it is illegal, even if a parent hands their child their beer to hold while they tie their shoe. She will probably learn her lesson, but I doubt she would win anything.
