Drug Possession: How Is Ecstasy Testing Legal?

Question by WAHOO: How is ecstasy testing legal?
Do they still have DanceSafe testing at raves? They used to take a shaving off your pill supposedly and test it and tell you whats in it, then give it back to you. I dont understand how this is legal or if it was just a scam to catch people? I havent been to a rave in years and Im curious
And on websites such as ecstasydata, and pillreports you send them your pill and they test it for you? How is this not against the law

same way home drugs tests are legal, theyre not supposed to give you drugs after they test them

edit: because they dont send them back, parents do it to see if their kids are on drugs

Dancesafe took a lot of crap for setting up booths at parties and field testing people’s ecstasy tablets, so they don’t really do it anymore. It is sort of gray area of the law. Yes, the dancesafe people are momentarily “in possession” of ecstasy while they are performing these tests, but they aren’t actually buying or selling ecstasy, and yes, distribution of a drug just means that the drug changes hands, whether or not money is involved, so when the dancesafe people give you your ecstasy tablet back, that could possibly be charged as distribution, but that’s a stretch. After the anti-ecstasy proliferation act was passed in the early 2000s, owners of a venue can be held responsible for drug use that takes place at their location, and of course it is hard to deny drug activity in your venue if you let Dancesafe set up and test people’s ecstasy tablets, so they don’t do that anymore. Because of the ambiguity surrounding the legality of this activity, I don’t think Dancesafe sets up booths at parties anymore. They may occasionally, but I haven’t seen them set up at a party in about ten years or so.

At pillreports, you don’t send in your pills. You test them yourself at home with the EZ Test kit, and post the results on the website. Ecstasydata testing is done in a lab which has a DEA license to handle controlled substances, so it is legal for them to do the testing. After they perform the tests, the rest of the sample is destroyed, and they are not allowed to post exact amounts of active substances in the pills they test, they can only post ratios of various substances. There are some test results listed on that website that give milligram content of MDMA, but those results are from the DEA itself, not from the ecstasydata lab.
