A friend of mine was pulled over and after a search, drugs were found on him. He was the passenger in the vehicle that was pulled over, but after searching, there were no drugs found in the car. My friend was taken to jail, and the cops took the driver of the vehicle back to her residence, and told her that if they didn’t let them search her house, then they would take her to jail and take her kids to social services, so the girl let the police search her house. During that search, there were drugs and a gun found in the residence, and its being placed on my friend. Was this search illegal? My friend says that the police had a search warrant only to search him and his possessions, and he was searched at the scene. The police returned to the residence where they thought he lived and searched the property even though his name isn’t on the lease…
Oh, I forgot to mention… There were no drugs found at the scene. My friend was taken to the precinct and thats when the drugs were found… The drugs weren’t found in the car or on the driver, but on the passenger after he was taken to the precinct. The driver is who they took back to their house… Also, I thought that its illegal for the cops to threaten or trick a person into letting them search anything? Isn’t that one of the definitions of an unlawful search?
ok, the warrant was only for the search of my friend, and not for the residence, just the place where he was found. I’ll tell him to talk it over with his attorney.

You have a higher expectation of privacy in your home than in your car, so the search would not be automatic.
There is a legal term called “constructive possession”. This means if something illegal is found in an area you have control over, you could be held responsible. Because it was your car, and drugs were found, they had probable cause to arrest you. Therefore, the threat of jail was real. As far as your kids, if you were taken to jail, that would be a possibility of temporary placement, at least while you were in jail.
The bottom line is that you consented to the search, so it is up to you to argue that consent was coerced.

she agreed. they searched. she legally had a right to refuse a search, so the police would have had to come back with a search warrant.

AND KNOW YOUR RIGHTS
Since she was the driver/owner of the car, she can be charged with the possession of the drugs along with your friend and she could of been arrested. The cops made a deal with her that if she gave permission to search her house she wouldn’t be charged. Because she let them in voluntarily, it will probably hold up in court. If she did not, they would of held her on the first drug bust and they would of then had enough to get a warrent without her permission. The result for your friend would of been the same but his friend would of been in a lot more trouble.
