Drug Possession: Possible Drug Test in MD?

In the last weekend of January, a friend and I were coming back from a concert when we got pulled over. I was driving under my provisional license and Maryland law says you can’t drive people around under your provisional until 5 months after you’ve had your license. So automatically i was given a $ 75 fine for that. Unfortunately we were searched, and my friend had a little marijuana on him. And because this was in my car, i was charged with “constructive possession” and he was charged with “possession”

We are both 17 (considered juveniles) and we were arranged to meet with a juvenile counselor. Just curious, if anybody knows this juvenile detention system, will I be drug tested? This is simply a question, and i would appreciate a straight forward answer. I don’t need comments about how “drugs are bad and will ruin your life”

Even though a “constructive possession” and you will most likely be found guilty of a possession charge you’re asking about “juvenile detention.”

I seriously doubt there will be any “detention” involved in your case.

The courts understand the difference between soft and hard drugs with marijuana being a soft drug.

Most courts place juvenile cases like this in a drug counseling system and probation…not detention.

Remember this, however, with juvenile records being “sealed” upon reaching “Age of Majority,” those files are still accessible by the courts. Should you get in trouble as an adult…your past could have a bearing on your future!

    You were very lucky.
    If you follow the rules of the counsellor you will have no criminal record.

    You will be drug tested regularly.

    PS JUvenile records are not sealed automatically. You have to go back to court at 18+ to have that done.
