Question by carlos: I (17 years old) got a ticket for possession of Marijuana, CVC 23222(a)?
I (17 years old) got a ticket for possession of Marijuana, CVC 23222 (a).
What are the total costs and consequences? What can I do? Can I pay the fine without letting my parents know? Will I lose my license?
I cant lose my license, I need to drive to school…
I ran a stop sign not even two weeks ago.. but before that my record has been completely clean.
I don’t care about the fine, I just really cannot lose my license.
Bay area California, and less than a gram of weed. The ticket also says its an infraction.
He also specifically stated on the ticket that it was an open container of Marijuana.
He asked me if it was ok to search my car, i asked if he could withoit a warrant, he then said im asking you if its ok. I said yeah go ahead. He asked do you have weed? And i said, I do theres some in the center console. He then looked all over my car. He didnt weigh it at least not infront of me, he said hed throw it away and I could leave. I smoked in the car beforehand, not even 10min before.

My car smelled, which gave him probable cause?
It is my car, I wasnt driving i was parked in a parking garage. The stop sign incident is seperate and happened 2 weeks prior. I could get a card since i turn 18 next month, my friends were in the car and they arent in trouble, only me. I want to keep them out of this mess. I WANT THIS TO BE DISMISSED. The ticket itself has a lot of wrong info, first the time, and the model of the car. The ticket also says bring parents to court. I also dont want to contest it because it was right next to a school, he could probably bring that up.
I told the c
Also can you contact me through email?
I told the cop the car is mine, i dont remember if i told him the weed was mine.

if this is your first time getting popped for anything you are automatically eligible for what they call “pre trial diversion”

google it or ask what it means on here, don’t waste your money on an attorney. you’ll be on probation for a year (not strict probation)

If you get introuble for ANYTHING, in that year you will get go to court and face this charge for marijuana and whatever charge you received while being on pre trial diversion

Penalties vary greatly from state to state and depending on the amount. Since you list neither, no one can answer you.

Dear Carlos, RE- RE- CHECK THE END OF MY ANSWER,I ADDED MORE INFO& QUESTIONS SO U CAN DO IT ON UR OWN NO NEED 4 A LAWYER,..Driving around with pot in your car is a crime in and of itself.Though one might assume it falls under the umbrella of simple possession of marijuana per California Health and Safety Code 11357(b) HS1, it does not.Driving in possession of marijuana (up to one ounce) is punished separately under California Vehicle Code 23222(b) VC. But either offense subjects you to the same penalty: up to a $ 100 fine, plus court costs.A savvy criminal defense attorney versed in California marijuana laws / or you should be able to prevent a conviction by arguing any of three legal defenses: that you are an authorized medical marijuana user or caregiver, that the pot didn’t belong to you, or 3.that the marijuana was discovered during an illegal search/ did you authorized him to search your car if you did not the search and whatever he found in not a legal search.. So think about these and if anyone fits that could help you.Authorized possession under California’s medical marijuana program ) Except as authorized by law, every person who possesses, while driving a motor vehicle upon a highway or on lands, as described in subdivision (b) of Section 23220, not more than one avoirdupois ounce of marijuana, other than concentrated cannabis as defined by Section 11006.5 of the Health and Safety Code, is guilty of an infraction punishable by a fine of not more than one hundred dollars ($ 100).It is the except as authorized by law” provision that permits an authorized California medical marijuana user or caregiver to possess the substance while driving. After all, how else would he or she get it home from the dispensary? It is important to understand that legally possessing pot while driving is different than smoking pot while driving. No one, including authorized medical marijuana users, are permitted to drive if they are “high” from consuming pot. Doing so subjects you to California “driving under the influence” DUI of marijuana charges. You don’t legally “possess” the marijuana, VC 23222(b) punishes driving while possessing marijuana. It therefore follows that if you don’t possess marijuana, you aren’t guilty of this crime. If you “possess” marijuana, it means you have control over the drug. “Control” can be actual or constructive. “Actual control” means that you have direct, physical control over the drug.VC 23222(b) punishes driving while possessing marijuana. It therefore follows that if you don’t possess marijuana, you aren’t guilty of this crime if you “possess” marijuana, it means you have control over the drug. “Control” can be actual or constructive. “Actual control” means that you have direct, physical control over the drug.i.e. You are actively smoking weed or have an unlit joint in your hand.”Constructive control,” on the other hand, means that you have access to the marijuana and the right to control it.Even while you are away from home, you have constructive possession of the pot that belongs to you and is in your dresser drawer. It isn’t hard to imagine a variety of instances where you could be caught driving with marijuana, where you don’t really possess it in the legal sense. i.e. cop finds the weed in the glove compartment, under the passenger seat, in the back seat, or in the trunk. If the marijuana is hidden anywhere except possibly on your person, it may be that you didn’t know it was there. After all, it could have been left behind by a friend, family member, or someone who just used your car, and that person simply forgot to take it with him or her. Whatever the circumstances, if the marijuana isn’t yours and you didn’t know it is there, then you didn’t “possess” the drug.If the police stop you for a routine traffic stop (you were speeding,i.e, and illegally search your car, so your ticket will be null and void. So here are your options which all are good if you do what I outlined you will be just fine. Yes you can deal with it without your parents, and you will not loose your license. Good Luck Best wishes. You will be just fine.
PS: OK Thanks 4 connecting to me, Now let ask some questions. Tell me how did you allow him to search your car? what was the question and answer Remember they have it on their Cam on the police Vehicle of the police officer. 2, You will not lose your license, 3, is this your car you were driving in? can you get a medical Marijuana card? if not does any of your friends family have access to the care that you were driving and what else you told him how and where he searched your car. Was the reason he stopped you because you Ran the stop sign? as to the issue of the amount is gram how did he know that did he weight it? PS: GIVE ME YOUR EMAIL YOU HAVE LOT’S OF GROUND TO CONTEST IT AND NO PARENTS
