Ok last night my husband and two other people were in a car and got pulled over, the guy who was driving just got out of jail a few weeks ago for possesion with intent to distribute. Cop searched the car and found a joint, it was not my husbands but the other two would not admit to whos it was, the cop said if noone would admit they would take all three in. What ended up happening is they take my husband in but not the other two. My husband asked why if he never pleaded to anything and asked why they didnt take anyone else in but the cop ignored him. What can be done about this?
hes going to file a complaint would this be of any help to him in court?

My uncle is in a high position in the FBI and they’re closely assotiated with cases like these. Since it’s going to be very hard to prove that your husband was unaware of the joint, unless one of the other men needs to fess up. Other than that, what he needs is a good lawyer and he probably should plead innocent so that the other men come under question. Hopefully he won’t be in too much trouble. Good luck!

Find More Drug Possession Information…

The only thing you can do is defend yourself in court against whatever charges are brought, and for that you need a lawyer. You can’t do anything about it without an attorney’s help.
Because your husbands so called “friends” failed to be honest…your husband learned the hard way about “dominion and control.”
Technically, under “constructive possession” laws the other passengers might have been arrested but the officer would have to prove without a reasonable doubt that they knew the illicit drug was in the vehicle.
With what little information you provide I have to assume the officer found the joint in close proximity to your husband.
My suggestion would be to plead not guilty at the arraignment hearing and ask for representation by an attorney.
You can file a complaint however at this point I don’t see any wrong-doing on part of the officers actions.
