You would not be sent to jail for, “guilt by association” or, “collective guilt.” It would have to be a separate charge such as, aiding and abetting, conspiracy, accessory, etc.
For instance, if you are in a vehicle and one individual has an open container, it could be said all were drinking at the time, sharing the alcohol, and guilty by association, however, it doesn’t work that way. It would still have to be proven that you were in fact drinking to be charged with a crime.
If you were with a group of individuals in a stolen vehicle, it would have to be proven in court that you had knowledge that the car was stolen and participated in the joy ride to be charged with any crime.
If you are at a party and some individuals are found to be in possession of illegal drugs, you would also have to be in possession of such drugs to be arrested and charged with a crime. You would not be charged simply because you happened to be there at the time.
Guilt by association is not a, “charge,” in and of itself.
Any time that you know of anything being done thats breaking the law. Whether its receiving an item that is stolen, or knowing that something was stolen, Assisting with getting rid of evidence associated with a crime, i.e. disposing of a body! You are guilty by association.
