Can anyone point me to any legitimate information about CURRENT Michigan’s Medical Marijuana Laws, specifically anything having to do with Dispensaries?

Hello,
I’m glad you thinking about opening a dispensary. personally, I believe that every dispensary that opens is another blow to the failed drug war.
The first place to start is with the Michigan Department of Health. The problem is medical marijuana dispensaries technically are not legal in Michigan. They operate in a “grey-zone”.
Basically, they are using the “affirmative-defense” this defense allows caregivers to fight any charge of possession with intent to distribute marijuana in criminal court. You have to prove that however you sold or provided marijuana too is a valid medical marijuana patient authorized to use and possess marijuana. This means you will have to subpena patient and prove your case in court.
Check with other dispensaries in the area, I believe what they are doing is actually giving away the medical marijuana to get around the selling charge. The dispensaries only suggest a “donation” price. So if a patient asks how much does this medical marijuana charge, the answer is nothing, its free but we do suggest a minimum donation.
Dispensary owners are taking a huge risk with this method but there are no shortage of people willing to take the risk and go to court to set a precedent setting case. Warning its very expensive as, you will arrested, have to bail out and hire a lawyer.
The good news, there are actually a few cities in Michigan moving forward and allowing dispensaries to obtain legal business licenses.
