Possession of Cocaine

Question by Hey whats up: Quick New York Marijuana Laws question.?
Criminal Possession of Marijuana states””Any amount in a public place burning or open to public view” That is what it says for CPM on NORML.org

OPEN TO PUBLIC VIEW:

Would sitting in a car, with weed rolled in a dutch (he rolled it at home I guess) in your pocket count as open to public view? It wasn’t burning, and it was in my friends pocket, if you weren’t looking for it, you wouldn’t see/find it, and we were in a parked car, and there was no probable cause except foggy windows. The cops didn’t ask us if they could check, they put us under arrest and proceeded to search us and the car. I was on the phone while my friend was waiting for his girl friend when they showed up. It didn’t smell like weed in my car or anything. I didn’t know my friend had weed.

Is that considered “open to public view”? Why am I being charged?
No, my friend also got the same charge, I didn’t mean he got off the hook, we both got charged with CPM

Also the car was parked.

Also, I hate people that say “fess up, you did it” and stupid things like that. I have no reason to lie, I was in the car with my friend, and I got caught, with him, I had no physical marijuana on me nor in my car, all the marijuana found was on my friend.
One more thing, when the cop came up to me, I was respectful and listened to what he said. I was on the phone, and the cop told me to get out, so I told my friend bye on the phone, and hung up, got out, and the cop then detained me with handcuffs.

cops think their job is to charge people with as many things as they possibly can because in their view they are getting criminals off of the street. they are stupid. get a lawyer and you will beat the charge but it will cost you a few thousand. when i got caught they gave me diversion which is where i had to go to some classes pay a fine and got my record seald. that was in ohio though, from what i understand new york has some of the most strict drug laws anywhere. my guess is that you will get your record seald or expunged if you plea guilty but make sure u get a lawyer before u go doing that.

trust me, the law doesnt matter to cops. they will do whatever they want and if you get a good lawyer you can prove that what they did was illegal and will not get charged. there are no negative concequences for the officer for violating your rights even if it is proven in court. the only way he gets penalized is if you sue him for harassment. these other people have never been in this situation… i have… i understand how it works… quit giving me thumbs downs… you are gonna give me a thumbs down for telling him what happend to me? hahaha give me a break.

i was in a car got pulled over for no reason except that they saw 4 kids in a car at midnight. then i was detained in the back of a cop car and had to sit there and watch them search my trunk without my permission (infact i said that they could not do it when they asked). then they found my pot and my bowl and i got skrewd… same thing that happend to u pretty much
