They are not being charged with using, just with possessing. Ownership is also irrelevant, the charge is possession, not ownership.
No, ignorance of the legal system is what they hope for and is most peoples down fall. You need to get one taken yourself so you have a fighting chance. when they read you your miranda rights it states “Anything you say or do can and will be used against you in the court of law”. So you must look out for yourself anyway you can since you are already on the losing end wants you’ve been charged. It helps to show you are clean. It’s no guarantee but better than not doing anything.

Not generally, because the crime of possession does not involve ownership. It requires only knowledge and access. When someone says “that is not my dope” that becomes evidence that they knew what it was and that it was there.
When the charge is for possession, the arresting officer is NOT saying you were USING. You are in POSSESSION with intent to SELL if you exceed the limit for that particular drug.
