Can I Get Arrested for Not Doing Anything at My House?
Question by AussieSteak: can i get arrested for not doing anything at my house?
my roommates sometimes party and get high with drugs. i am the only one in the house that doesn’t drink or do drugs, if their party gets ‘busted’ (in the future) by the police, can the police arrest me since i live in a house that has drugs?
Also, there is one roommate that is underage and he sometimes drinks, what if the police arrest him, can they also arrest me even if i didnt do anything? i never buy the underage kid alcohol and i don’t do drugs or even party with them.

More Illegal Drug Possession Information…
If they have proof that you are clean then no. But they may take you to court and ask you questions about your friends. If you stay clear of drugs and DUI, your good for the most part.
yeah… they would probably book you. because your an accessory to a crime : possession of illegal drugs.
Yes they can
If you see something illegal, you are required by law to report it. Therefore if you live in a house where people smoke and drink underage, and you know it’s happening and don’t say anything, you will be arrested also if they decide to raid the house.
technically they could arrest you because you were aware of illegal activities occurring in your household. your best bet is to move out or not allow those things to happen at your house.
Yes, in both cases. In the first case, you can be arrested for keeping a disorderly house for letting the others do drugs there. If they are dealing, you can be charged with conspiracy for not reporting them.
In the second case, you can be charged with contributing to the delinquency of a minor for allowing him to drink in your residence.
You’d do well to move.

Who actually owns the house and lives there, or has their name on the lease? These could be factors of culpability if the house gets raided. Make certain that you have NOTHING illegal in your own room, and if you are ever rounded up with the rest, demand a drug test.
Its a fine line. I think that if you own the house (which you sort of do), that it can called giving a place for people to do illegal activity. With the minor, it is also giving a place for a minor to drink alcohol. I would say that you would probably get arrested at the party if it got busted, whether you got charged with something is questionable. I would just go to a friend’s house the night that your roommate’s have a party and come back when it’s done, then you don’t have to worry about it.
There is a legal principle called “constructive possession”. This means if there is something illegal in an area you control, and you know it is there, then you are legally responsible. You can be arrested for possession of drugs and allowing a minor to drink.
That is my legal opinion. However, officers do have discretion in these matters. Chances are, if they are all adults and accept responsibility for the drugs and alcohol, you may not be charged.
They arent going to arrest you but they are going to ask you what you know.
Yes/ The police assume if you live with them that you act like them.
You are judged by the company you keep. This is very true with the police and the courts.
It’s not fair and it’s not justice, but it’s the way the real world works.
Room mates and house mates are nothing but trouble.
If it’s their house you move out. If it’s your house you move them out. Somebody has got to go if you want to stay out of trouble.
Yes they will
