Can You Go to Jail If…?
Question by ~*Understanding Patience*~: Can you go to jail if…?
…you are with someone who has cocaine on them (you don’t know about it of coarse) or has it in their home and the cops find it? What is the procedure? Do they book you then drug test you and let you go? Or do you still have to go through the courts and ‘prove’ you don’t do drugs?

If the drugs are on the person, they are the only one that gets charged.
If the drugs are in the immediate area, and no one claims them, everyone can be charged. I can tell you from experience the chances are slim anyone will admit ownership.
If it is your house or your car, things get worse. There is a legal principle called “constructive possession”. If you are in control of the area, and there is something illegal, you can be held responsible.

Being your asking you know and they will find out that you know and you will be charged too. If those are your friends find new ones…. One day they will be in your car or stash their stuff in your property to cover their butts.
If the drugs are found in their house, their car or on their person, and not on your person, in your house or car, then they are the ones who are arrested. You are not the one at fault, and should not be charged at all. Your last question shows your ignorance of the law. In this country a person is innocent until proved guilty in a court of law, and not the other way around.
Yes, for sure.
Your friend have to tell them that you have nothing to do with it and you had no idea of what he had on him.
So you are innocent.
I have personally witnessed cases where a neighbor was charged with possession, and searched exhaustively for any minor technical violation of anything at all to cover the bad bust. In one case, the idiots even did this to an undercover officer, who then had to take the hit to maintain cover. Johnny Cash had a song about how most cops are criminals with badges, who only care about getting paid.
