Yes as you are the owner or listed tenant of the home. It is your legal responsibility to ensure the drug activity does not take place in your home. In other words if the person in question is arrested in your home, there are good odds you will be arrested as well.

    There is a legal principle called “constructive possession”. If you are the owner or in charge of the house, and you are aware of something illegal in that house, you are considered in legal possession.

    If you are not in charge of the house, you can not be held accountable.

    If you ‘share’ the house and the drugs are found in the ‘common’ area, you could be held liable. If the drugs is in a location where you do not have normal access, you would have a strong defense against possession. These boundaries must be well established and it still depends on the state you are in. States have different court rules and different interpretations of 4th Amendment laws. If it is a roommate issue, cover yourself. Possibly have them store the items in a lock-box or something similar. Check with your local laws.
