In the state of idaho, if your not on probation and don’t have anything on your record, and you take a drug test and it comes up positive, can you go to jail?
Or will they just wave it, or fine you?

Not familiar with the state laws in Idaho, but where I live the only way a positive drug test will result in a fine or jail time is if the person being tested is on probation for a drug or alcohol related offense. Aside from that, a positive drug test administered by an employer only results in termination from the company, and if a person trying to get into the military pisses hot he/she is only disqualified from entering but no legal action is taken.
Interesting side note: I can’t speak for the military, but in my state company drug tests primarily are designed to detect marijuana, and don’t actually even check for consumption of other drugs, like heroin.
I’m not familiar with Idaho state laws, but having a P.O. as a neighbor for a while, and having been on UNSUPERVISED probation due to a DUI, I asked him: “If I got caught driving sober under my suspension and were charged with Driving While Licence Revoked, would a conviction activate my sentence?”, he replied, “If you aren’t doing the same thing you were convicted of and sentenced for, you don’t really need to worry about it.” That being said, this was a MISDEMEANOR, and I was placed on UNSUOERVISED probation. If the conviction in question had anything to do with possession, or the court specifically told you to stay off of the reefer (If it’s anything else, you shouldn’t need to sweat it staying in your system for that long…so don’t do it in the 48-72 hour period before your test…EASY), you should retain
legal counsel. If the charges are not related to substance abuse/possession/distribution/manufacture-of, It won’t look good for you by any means, but as far as activating a suspended sentence…not likely.
I’m not an attorney and I’m not familiar with Idaho’s court system, or the political
climate thereof. I’m just speaking from
experience. Support for medicinal, and even recreationl use of Marijuana (if that’s what the deal is) is growing nationwide, especially among left-wing politicians and justices. I would be shocked if they imposed an active sentence for recreational MJ use, or simple possession.
