What Are Some Possibilities of Getting Charged With Possesion of Marijuana?

Question by The Wise One: What are some possibilities of getting charged with possesion of marijuana?
PLEASE READ THE FOLLOWING DETAILS BEFORE ANSWERING:
So I was sitting on the sidewalk and the cops showed up because they got a call that some kids might have been smoking marijuana on the sidewalk.
There was 5 of us.
They let 3 of them go, except me and my friend “X”
X had about $ 10-25 worth of weed in a $ 5 dollar bill,
As they told us to empty our pockets and belongings so they could search us he put the weed in a five dollar bill. but had about 10-20 $ 5 dollar bills in his pocket.

The police charged us both with possesion, but DIDN’T ARREST US.
They said court would decide who is guilty.
I NEVER touched his money nor the weed. I didn’t buy weed. All I had was a lighter and my cellphone.

They made our parents pick us up and they gave my father a paper; which he didn’t show me. (He was very mad at me because of the situation so I stayed quiet the whole time)

Another one of my friends suggested that if I get a lawyer to try to get the charges thrown out on the grounds of it being circumstantial.
(I don’t know what that means or how it works so it’d be helpful if someone explained it)

I’m currently 17 years old. – turning 18 july of next summer.

My general question is it likely I’ll be found guilty?
And another friend said he was arrested but didn’t have court until a month after, is court always a month after the event? or does it depend on the crime/event?

One last question: Is it nessecary to be drug tested or can I tell them I don’t want to be drug tested?

MOST IMPORTANT DETAIL:
The cop charged us both because the marijuana in the bill was on the ground, in the “proximity” of both of us.

and details about my friend “X”, he was already on probation.

and I have a clean record. “X” Has been on probation twice in his life I belive.

Any details and help on one, two, or any of these questions are helpful.
Please help me with this, I’ve never been to court or in any kind of illegal situation. and I’m really worried about whats going to happen.
Me and my family are praying things turn out well for me.

Oh and I live in USA, Virginia if that matters at all.
Can they really charge both of us for possesion of the same substance?
I mean…. logically, it was either his, or mine.
and I KNOW it wasn’t mine. nor did I even touch it. I didn’t know he had it either.

If I go to jail for this, I’m moving out of the country as soon as I get out.
There’s no real justice if this is how things work in this country. -.-

Get a lawyer and hope for the best outcome. Sorry about your luck but if you knew he had it, or did smoke it and don’t want to confess you need to step up and take responsibility. You will be a better person. If your innocent, fight it. They will take into consideration your current record. I doubt you will go to jail and if so it won’t be long. Very short.

If you do end up going to jail… look at it as a learning experience. You will be a better man for it in the end. It will teach you many things believe it or not.

And a tip: Dude, don’t hang out with people like that. Hes a bad influence and is obviously causing problems for you that could affect you for the rest of your life. He makes you look bad. So like I said, good luck. Hope he doesn’t drag you down too bad.

    ok so… it is unlikely you will be charged and it is a good idea to consent to a drug test because if its true you went smokeing then theres nothing to hide and it will help your case the most sivere punishment would be a fine no jail time

    Yes they can charge both of you for possession under those circumstances because for all they know both of you could’ve chipped in for the dope. It sucks but they do it all the time, even in more liberal states like California.

    In your place I’d cooperate. As for drug testing it’s going to be part of any court appointed diversion program you’ll probably have to go through. Of course you can refuse and end up going a stint in juvenile correctional facility.

    As an adult the very worse case scenario you could get 30 days in jail and a 500 dollar fine. As a juvenile with a clean record you’re more likely to get a fine and probation. If you complete your probation successfully without any violations the conviction won’t even go onto your record. You’re lucky Virginia has a conditional release program.

Usually, conditional release lets a person opt for probation rather than trial. After successfully completing probation, the individual’s criminal record does not reflect the charge”.
