It depends on the state which the crime took place, criminal history, and the judge that poses the sentence.
More specifics please. It varies from state to state. Is this the person’s first time for a drug felony? In many states the first and or second time for simple possession charges the court will offer a plea agreement.
In Arizona most first time drug offenders are offered a “Diversion Program”. This includes regular drug testing, counseling, 12 step program participation, etc. It is used in conjuction with a probation period of one to three years.
Further, the court will sometimes offer to make it an “undesignated felony”. In other words, if you complete the program, you will not have a felony conviction on your record. The program is used to educate individuals, and stop illegal drug use before you end up in more legal situations.
Hopefully your state offers such a program. It gives you a second chance not to become a convicted felony for the rest of your life. And maybe, just maybe, it will stop you from being a drug addict too! Good luck.
