Felony Drug Possession: Is Being High on Marijuana at Work, as a Missouri Certified Nurse Aide, Considered Neglect?

Question by Tr: is being high on marijuana at work, as a Missouri Certified Nurse Aide, considered neglect?
A friend of mine works at a nursing home and uses marijuana. Recently she mentioned she almost dropped a resident because she was so high. I’m wondering, if i report her, will she be charged with neglect or get fired or what??? Will she be able to work as a CNA anymore?
ALSO… would i report to her employer or to senior services? i couldnt find anything about drug use under their definition of neglect, so im not sure if its something they would handle (senior services that it)

If you don’t report her, you are considered an accompolice and just as bad as her for letting it continue. Do you want to wait until she actually hurts someone?
She needs to be reported and will definitely lose her job and probably lose her certification too. Maybe she will learn a hard lesson.

that is disgraceful, she will probably get fired and she should be fired whatever next?

  • Sandy:

Not only is it neglect, it is a felony. She can be charged with ALL sorts of nasty things, from unprofessional conduct, to endangering patients, to “internal possession”. (This is assuming she comes up positive in a drug test, of course – they won’t just take your word for it).
She will certainly get fired, probably do some time, and she will lose her license and NEVER work as a CNA again in any state.
    **Hope this helps!

Ask yourself, what would you like to see happen if a drug user was taking care of one of your parents or some other loved one and got so high at work that they almost drop them. In my opinion, she should get fired at the very least – she deserves to get fired and CNA license revoked as well!! Maybe even a jail term for endangering someone else’s health or well being.
